The Department of Justice is reported now conducting a criminal investigation into Trinity Industries over possibly defective guardrail. This comes after Trinity Guardrail "passed" safety investigations last month. This could lead to more Trinity Guardrail lawsuits moving forward. Federal investigators are currently conducting interviews with potential witnesses regarding the relationship between Trinity and the FHWA. They DOJ has also reported issued supoenes for documents from the court. Trinity issued the following comment, “Trinity has not been contacted by the Department of Justice.” The news of the criminal probe into Trinity caused the stock to fall 7 percent this morning. U.S. Senator Richard Blumenthal previously called for an investigation into Trinity and the possibly deadly defective guardrails. He said the test which Trinity passed was “rife with flaws”.
There have been numerous lawsuits filed against Trinity, with the lastest coming from the family in Arizona when a man died after being peirced by a Trinity Guardrail. The lawsuit claims that the Trinity Guardrail was defective and caused his death. There are over 3 thousand Trinity Guardrails installed in the state of Arizona. There have been at least 8 deaths which have been linked to Trinity Guardrails.
